Subscription

3.1 Introductory provisions

These terms and conditions (hereinafter: Terms) govern the relationship between the service provider and the subscriber concerning the monthly subscription to the online furniture configurator available at mojmizar.si (hereinafter: Service).

The service provider is Poslovno svetovanje, Rok Setnikar s.p. (hereinafter: Provider), whose details are listed in section 2 of this page.

By placing an order and paying the subscription, the subscriber agrees to all provisions of these Terms in full. Matters not specifically regulated are governed by the Slovenian Code of Obligations (OZ), Consumer Protection Act (ZVPot-1), Electronic Commerce and Electronic Signature Act (ZEPEP), General Data Protection Regulation (GDPR), Personal Data Protection Act (ZVOP-2), and other applicable regulations of the Republic of Slovenia.

3.2 Service description and scope

The Service is a web application for 3D configuration of custom furniture, intended for end users. The exact functionality per plan (Basic / Standard / Professional) is described on the /pricing page and is binding for each subscription.

The Provider reserves the right to make technical improvements, updates and minor feature changes without prior notice, as long as these do not materially alter the scope of the paid plan.

3.3 Conclusion of the contract

The subscription contract is concluded electronically when the subscriber selects a plan on /pricing, signs in / registers a user account, confirms payment on the secure Stripe payment platform, and thereby gains immediate access to the paid features.

The contract is concluded for an indefinite period with a one-month billing cycle and automatically renews for each subsequent billing period until terminated by the subscriber in accordance with section 3.6.

3.4 Price, payment and auto-renewal

Plan prices are listed on /pricing in euros (€). The Provider is not liable for VAT under Article 94(1) of ZDDV-1, therefore prices do not include VAT.

Payment is made in advance for each billing period via the Stripe payment platform (Stripe Payments Europe, Ltd., Ireland), an independent processor of payment data.

The subscription auto-renews each month with a payment using the payment method the subscriber provided at signup. The subscriber is notified by email after each successful payment and receives an invoice in PDF format.

3.5 Right of withdrawal

Under Article 43.č of ZVPot-1, in distance contracts the consumer generally has 14 days to withdraw from the contract without giving a reason.

By paying the subscription and accessing the digital content immediately, the subscriber expressly consents that the Service commences for them before the 14-day withdrawal period expires, and thereby loses the right of withdrawal under point 5 of Article 43.d of ZVPot-1.

This loss of the right of withdrawal does not affect the right to terminate the subscription under section 3.6 or the subscriber's rights under statutory warranty for defects.

3.6 Termination of the subscription

The subscriber may terminate the subscription at any time, without giving a reason, via:

• the self-service Stripe portal accessible via /profile/subscription;
• an email sent to info@mojmizar.si from the email address associated with the account.

Termination takes effect with the next billing period: access to paid features remains active until the end of the current period for which the subscriber has already paid. The Provider does not pro-rate refunds for the unused remainder of the current period, except where required by applicable law.

3.7 Refunds and complaints

In the event of material defects in the Service which the Provider does not remedy within a reasonable time, the subscriber may request a proportional refund of the paid subscription. Complaints are sent to info@mojmizar.si with a description of the defect.

The Provider handles complaints within 8 business days and informs the subscriber of the decision.

3.8 Liability

The Provider strives to ensure 24/7 Service availability but does not guarantee uninterrupted operation. The Service is provided "as is". The Provider is not liable for indirect, incidental or consequential damages, lost business opportunities or data loss, except in cases of intent or gross negligence.

The Provider's total liability for any claim is limited to the amount the subscriber paid for the subscription in the 12 months preceding the event that caused the damage.

3.9 Ownership and intellectual property

All software, design, code, images, icons and texts of the Service are owned by the Provider or its licensors. By paying the subscription, the subscriber acquires a non-transferable, non-exclusive right to use the Service for personal / professional purposes in accordance with these Terms.

Content created by the subscriber within the Service (3D models, plans, images) remains their property. The Provider is the operator of the technical storage of this content and processes it solely for the purpose of providing the Service.

3.10 Changes to terms and prices

The Provider may change these Terms or plan prices with at least 30 days' prior notice by email. If the subscriber does not agree, they may terminate the subscription before the changes take effect. Continued use of the Service after the changes take effect constitutes acceptance of the amended terms.

3.11 Governing law and jurisdiction

These relations are governed by the laws of the Republic of Slovenia. The parties will endeavour to resolve any disputes amicably. If that is not possible, disputes shall be resolved by the competent court at the Provider's registered seat.

The consumer may also attempt to resolve disputes via the European Commission Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

4.1 Acceptance of terms

By accessing and using mojmizar.si and the associated online configurator, the user agrees to these terms of use. If you do not agree, do not use the Service.

4.2 User account

A user account is required to use paid features. The user is required to:

• provide truthful and up-to-date information;
• protect their login credentials from third-party access;
• promptly notify the Provider of any suspected account misuse.

4.3 Permitted use

The Service is used to design, visualise and save furniture plans for the user's personal or professional needs.

4.4 Prohibited use

Without explicit written permission of the Provider, it is prohibited to:

• reverse-engineer, decompile or otherwise disassemble the Service code;
• perform automated scraping of content at a scale that strains infrastructure;
• use the Service for unlawful purposes or to distribute content infringing third-party rights;
• resell or publicly share paid features with third parties without an appropriate subscription.

4.5 User content

The user retains ownership of designs they create within the Service. By uploading content, the user grants the Provider a limited, non-exclusive licence for technical processing (storage, display, backup) solely for the purpose of providing the Service.

The user may export their designs in formats the Service supports and delete them at any time via account settings.

4.6 Personal data protection

The Provider processes personal data (name, email, payment data via Stripe, account content) in accordance with GDPR and ZVOP-2. The legal basis is performance of the contract (Art. 6(1)(b) GDPR) and legitimate interests (Art. 6(1)(f) GDPR).

Data processors:

• Stripe Payments Europe, Ltd. — payment processing; details at stripe.com/privacy.
• Supabase, Inc. — account data and content storage (Frankfurt, EU); supabase.com/privacy.
• Vercel, Inc. — application hosting and access logs; vercel.com/legal/privacy-policy.

The user has the right of access, rectification, erasure, restriction of processing and portability of their data. Requests are sent to info@mojmizar.si. Complaints may be filed with the Information Commissioner of the Republic of Slovenia (ip-rs.si).

4.7 Cookies

The site uses only technically necessary cookies for operation (login, security, cart, language settings) and optionally analytics cookies. The user can manage cookies via the browser or the consent banner shown on first visit.

4.8 Technical requirements and availability

The Service is optimised for modern browsers (the latest two major versions of Chrome, Firefox, Safari, Edge) on devices that support WebGL. The Provider is not liable for limited or disabled access due to incompatible or outdated user devices.

4.9 Third-party services and content

The Service may include links to third-party services (e.g. the Stripe payment platform, Google sign-in). The operation, content and terms of those services are governed by each provider's own terms.

4.10 Changes to the terms of use

The Provider may update these Terms of Use from time to time. The latest version is always available on this page. The last-updated date is shown in the footer.
