By using the website and placing an order, the Customer is deemed to fully agree with all provisions of these Terms.
For matters not specifically regulated, the provisions of ZVPot-1, OZ, GDPR, ZVOP-2, and other applicable regulations of the Republic of Slovenia apply.
Nature of Products and Offers
The Provider's products are unique and often custom-made, so minor deviations in color, structure, texture, and dimensions may occur, which do not constitute a material defect.
All descriptions, images, and drawings are symbolic and informative.
The Provider reserves the right to make minor technical or aesthetic changes that do not affect the functionality of the product.
Order and Contract Conclusion
The Customer can place an order through the online form, configurator, email, or in person.
After receiving the order, the Provider prepares an offer or estimate with all product and payment details.
The contract is considered concluded on the day the Customer confirms the offer or makes payment of the estimate.
After order confirmation, changes (dimensions, colors, material) are no longer possible, except by special agreement, which may include additional costs.
The Provider reserves the right to refuse an order without explanation, especially if it determines that production is not feasible or if there is doubt about the authenticity of the order.
Prices and Payments
All prices are in euros (€) and include VAT, unless otherwise stated.
Payment is made based on the estimate that the Provider sends to the Customer after order confirmation.
Advance payment of up to 50% of the order value is required only by special agreement between the Provider and Customer, when dictated by the type of order, complexity of execution, or value of materials.
If advance payment is not agreed upon, full payment is made after delivery or collection of the product, according to the agreement.
The production deadline begins after order confirmation and, if agreed, after receipt of advance payment.
The Provider reserves the right to require partial or full advance payment in cases of larger or individual orders.
Prices on the website are informative and may differ from the final offer depending on materials, changes, or individual Customer requirements.
Delivery and Collection
Delivery deadlines are informative and are not an essential part of the contract, unless expressly stated otherwise.
The Provider is not responsible for delays resulting from force majeure, supplier delays, or changed Customer requirements.
The Customer is obliged to inspect the goods upon collection and record any visible defects in the delivery note or collection record.
If the Customer fails to do so, the goods are considered accepted without defects.
After collection, the Provider does not accept complaints for defects that could have been identified during inspection.
Right of Withdrawal (in accordance with ZVPot-1)
If it is a custom-made product, the consumer does not have the right to withdraw from the contract within 14 days, in accordance with Article 135 of ZVPot-1.
The right of withdrawal applies only to pre-made products that have not been customized to the consumer's needs.
If the consumer nevertheless exercises withdrawal, actual costs of materials and work already incurred may be charged.
Withdrawal is only possible in writing to the Provider's email address with a clear description of the request.
In case of justified withdrawal, the Provider refunds the paid amount within 14 days after confirmation of the request.
Complaints and Material Defects
The Provider is only responsible for non-conformity of goods that exists at the time of delivery and significantly affects the usability of the product.
Complaints must be submitted in writing (email) within eight days of goods collection, with a description of the defect and photographic evidence.
The Provider is not obliged to process complaints submitted after this deadline, unless otherwise required by law.
Complaints are not possible if they concern natural properties of wood (color variations, knots, grain, patina), mechanical damage after collection, unauthorized Customer interventions, or improper maintenance.
In case of a justified complaint, the Provider has the right to repair the product or replace it within a reasonable time.
Refund of the purchase price is a last resort if repair or replacement is not possible.
Warranty and Maintenance
Products do not have a special warranty unless expressly stated in the offer or invoice.
Legal liability for non-conformity of goods applies according to ZVPot-1, but does not apply to wear and damage resulting from use.
The Provider offers maintenance services by agreement.
Limitation of Liability
The Provider is not responsible for indirect or consequential damage (loss of income, time, data, etc.).
The Provider's total liability is limited to the value of the order.
The Provider does not assume responsibility for errors arising from improper handling by the Customer or third parties.
Personal Data Protection
The Provider processes personal data in accordance with GDPR and ZVOP-2.
Data is used exclusively for the purpose of order execution and communication with the Customer.
Data is not shared with third parties, except contractual processors (e.g., delivery services).
The Customer can request access, correction, or deletion of their data at any time.
Copyright and Intellectual Property
All content (plans, sketches, drawings, texts, images) is the property of the Provider and may not be copied, shared, or used without written permission.
For custom-made products, all project plans and technical documentation remain the property of the Provider.
Out-of-Court Dispute Resolution
The Provider respects ZVPot-1 and enables out-of-court dispute resolution through IRPS or ZPS, but does not recognize any ADR provider as exclusively competent.
For judicial dispute resolution, the court at the Provider's headquarters is competent.
Final Provisions
These Terms are valid from the date of publication on the website and replace all previous versions.
The Provider reserves the right to make changes without prior notice.
The law of the Republic of Slovenia applies to the relationship between the Provider and Customer.
